I managed to somehow work around this bug, by exporting only the skeleton--> create new scene--> import skeleton in--> create there the control rig--> export/ save as maya ACII. Load my orginal scene--->import skeleton with control rig--> delete orginal one and here u go for skinning.
All tough when i first did this and saved, next time i loaded file skeleton was screwd, but when i added key frame to frame 1
i have now weightpainted character fully and seems to be allright.
This problem was very thrustrating and i hope this can help some ufellow cg struglers
